Rights of Use of your Photos

We’ve seen your photo and think it’s great. We would love to share it with others. We therefore intend to use the photos posted by you on Instagram/Facebook/Pinterest/Twitter and make them visible to all our customers. We need your general consent and your consent under Data Privacy Law.

1. Scope of consent

By replying to the message from our Instagram/Facebook/Pinterest/Twitter page with “#YesBritax” you are saying that

  • you are an adult (at least eighteen years of age),
  • you hold all rights to the photo/photos,
  • all of the people shown in the photo/photos have given you their consent to using the photo/photos and granting us rights to them
  • our use of your photo/photos does not infringe any third-party rights and is not unlawful and
  • that you have read the terms of use set out below and agree to them.

You grant us (Britax Römer Kindersicherheit GmbH, Theodor-Heuss-Straße 9, 89340 Leipheim, Federal Republic of Germany) an unlimited, non-exclusive, assignable, sublicensable, perpetual and worldwide right to use the photo/photos that you post or have posted on Instagram/Facebook/Pinterest with a Britax, Britax Römer or Römer hashtag. This means that we have the right to use the photo/photos with such a hashtag as digital or non-digital content. That usage might, for instance comprise their use in our online shop, in a retail outlet selling Britax products, in Britax Römer newsletters, in posts on Britax Römer social networks, in outdoor advertising, on posters and in other promotions. We are not obliged to use the photo/photos, however.

You waive any payment for use of the photo/photos in this connection as well as any right to be identified as originator / proprietor of rights.

2. Right of revocation

You are entitled to revoke the right of use granted at any time and can do so by sending us an email to the following address: press@britax.com. In that case we will no longer use the photo/photos in future and remove them within a reasonable period of time.

3. Consent under Data Privacy Law

You agree that we will post the photos on the Internet for the abovementioned purposes. When the photo provides information on your ethnic origin, religion or health (e.g. skin colour, headgear, glasses), your consent shall also include this information. Information on the internet is accessible worldwide and can be found with the help of search engines. It can also be linked with other information, from which personality profiles about you can possibly be created. Information that is posted on the Internet, including photos, can be copied and redistributed easily. There are specialised archiving services that have the purpose of permanently documenting the status of certain websites on specified dates. As a result, information published on the internet may continue to appear elsewhere even after its deletion on the original site.

This consent is voluntary. You can refuse it without providing reasons, without the fear of suffering any disadvantages. You can also revoke this consent at any time in text form (e.g. letter, e-mail). The photos will then be immediately removed from our website and no longer used.

4. Guarantee

We would like to make sure that use of the photo/photos is quite lawful and that we do not infringe any rights held by third parties or any legislation. By replying “#YesBritax” you are saying that you hold all rights to your photo/photos, have obtained the consent of the person(s) shown to the grant of any rights thereto and that our usage as described does not infringe any rights held by third parties or any legislation. You are also confirming that will release and indemnify us with regard to any demands, claim in damages, liability and costs arising in connection with use of the photos as described if the above statement should prove inaccurate.

5. Limit on liability

By replying “#YesBritax” you are agreeing with us that you will never hold us liable for any direct, indirect, incidental or consequential losses, costs, damage, fees, expenditure or loss of profits, loss of business, contracts, business opportunities, loss of goodwill, loss of revenue, loss of envisaged savings, or for the corruption of data or information or any other prejudice in connection with use of the images as described. This limit on liability does not apply to damage deriving from loss of life, personal injury or damage to health as a result of negligent breach of duty by us or any deliberate or negligent breach of duty on the part of one of our statutory representatives or agents, nor to any other loss or damage deriving from grossly negligent breach of duty by us or to deliberate or grossly negligent breach of duty on the part of one of our statutory representatives or agents. This does not affect liability under the Product Liability Act.

Nutzungsrechte für deine Fotos

Wir sind auf dein Foto aufmerksam geworden und finden es toll. Wir würden es gerne mit anderen teilen. Zu diesem Zweck beabsichtigen wir, die von dir auf Instagram/Facebook/Pinterest/Twitter geposteten Fotos zu nutzen und sie für alle unsere Kunden sichtbar zu machen. Hierfür benötigen wir deine Zustimmung und deine datenschutzrechtliche Einwilligung.

1. Umfang der Zustimmung

Wenn du auf die Nachricht von unserem Instagram-/Facebook-/Pinterest-/Twitter- Konto mit „#YesBritax“ antwortest, erklärt Du damit, dass

  • du volljährig (mindestens achtzehn Jahre alt) bist,
  • du Inhaber aller Rechte an dem Foto/ den Fotos bist,
  • alle auf dem Foto / den Fotos abgebildeten Personen Dir ihre Zustimmung gegeben haben, das Foto/ die Fotos zu nutzen und uns die Rechte daran einzuräumen
  • die Nutzung deines /deiner Fotos durch uns nicht die Rechte Dritter verletzt oder gegen ein Gesetz verstößt und,
  • dass du die folgenden Nutzungsbedingungen gelesen hast und ihnen zustimmst.

Du räumst uns (Britax Römer Kindersicherheit GmbH, Theodor-Heuss-Straße 9, 89340 Leipheim, Bundesrepublik Deutschland) das unbeschränkte, nicht ausschließliche, übertragbare, unterlizenzierbare, unbefristete, weltweite Nutzungsrecht an dem Foto/den Fotos ein, die du auf Instagram/Facebook/Pinterest mit einem zu Britax, Britax Römer oder Römer gehörigen Hashtag postest oder bereits gepostet hast.

Damit haben wir das Recht, das Foto / die Fotos mit dem entsprechenden Hashtag als digitale oder nicht-digitale Inhalte zu nutzen. Die Nutzung umfasst beispielsweise die Verwendung der Bilder in unserem Online Shop, in einem Ladengeschäft mit Britax Produkten, in Britax Römer Newslettern, in Posts in den sozialen Netzwerken von Britax Römer, in Außenreklame, Postern so-wie sonstiger Werbung. Zu einer Nutzung des /der Fotos sind wir jedoch nicht verpflichtet.

Du verzichtest in diesem Zusammenhang auf eine Vergütung für die Nutzung des / der Fotos und auf eine namentliche Nennung als Urheber / Rechteinhaber.

2. Widerrufsrecht

Du kannst das eingeräumte Nutzungsrecht jederzeit uns gegenüber widerrufen, indem du uns eine E-Mail an die folgende Adresse schickst: press@britax.com. In diesem Fall werden wir das Foto / die Fotos in Zukunft nicht mehr nutzen und innerhalb angemessener Zeit entfernen.

3. Datenschutzrechtliche Einwilligung

Du willigst ein, dass wir zu den oben genannten Zwecken die Fotos von uns ins Internet eingestellt werden. Soweit sich aus dem Fotos Hinweise auf deine ethnische Herkunft, Religion oder Gesundheit ergeben (z. B. Hautfarbe, Kopfbedeckung, Brille), bezieht sich Deine Einwilligung auch auf diese Angaben. Informationen im Internet sind weltweit zugänglich und können mit Suchmaschinen gefunden und mit anderen Informationen verknüpft werden, woraus sich unter Umständen Persönlichkeitsprofile über Dich erstellen lassen. Ins Internet gestellte Informationen, einschließlich Fotos, können problemlos kopiert und weiterverbreitet werden. Es gibt spezialisierte Archivierungsdienste, deren Ziel es ist, den Zustand bestimmter Websites zu bestimmten Terminen dauerhaft zu dokumentieren. Dies kann dazu führen, dass im Internet veröffentlichte Informationen auch nach ihrer Löschung auf der Ursprungs-Seite weiterhin andernorts aufzufinden sind.

Diese Einwilligung ist freiwillig. Du kann sie ohne Angabe von Gründen verweigern, ohne dass du deswegen Nachteile zu befürchten hättest. Du kannst diese Einwilligung zudem jederzeit in Textform (z. B. Brief, E-Mail) widerrufen. Die Fotos werden dann unverzüglich aus dem Internetangebot von uns entfernt und nicht mehr weiter genutzt.

4. Gewährleistung

Wir möchten sicherstellen, dass die Nutzung des /der Fotos rechtlich in Ordnung ist und wir keine Rechte Dritter oder anwendbaren Gesetzte verletzen. Indem du uns mit „#YesBritax“ antwortest, erklärst du, dass du alle Rechte an deinem Foto / deinen Fotos hast, die Zustimmung der abgebildeten Person(en) eingeholt hast, etwaige Rechte daran abzugeben und die Nutzung durch uns wie beschrieben nicht die Rechte Dritter verletzt oder gegen ein Gesetz verstößt. Außerdem bestätigst du, dass du uns von etwaigen Forderungen, Schadensersatz, Haftung und Kosten, die im Zusammenhang mit der oben beschriebenen Nutzung der Fotos entstehen, freistellst und uns schadlos hältst, wenn die vorgenannte Erklärung nicht richtig ist.

5. Haftungsbeschränkung

Indem du uns mit „#YesBritax“ antwortest vereinbarst du mir uns, dass du uns in keinem Fall für direkte, indirekte, zufällige oder als Folge entstehende Verluste, Kosten, Schäden, Gebühren oder Ausgaben oder entgangene Gewinne, entgangene Geschäfte, Verträge, Geschäftsgelegenheiten, Verlust des Firmenwerts, Einkommensverlust, Verlust erwarteter Einsparungen Verlust bzw. Korruption von Daten oder Information oder etwaige andere Beeinträchtigungen im Zusammenhang mit der beschriebenen Nutzung der Bilder haftbar machst. Diese Haftungsbeschränkung gilt nicht für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer fahrlässigen Pflichtverletzung durch uns oder einer vorsätzlichen oder fahrlässigen Pflichtverletzung eines unserer gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen sowie sonstige Schäden, die auf einer grob fahrlässigen Pflichtverletzung durch uns oder auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung eines unserer gesetzlichen Vertreters oder Erfüllungsgehilfen. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.
